You should read it all carefully. You are advised to consult a Solicitor as soon as possible. You have a right to ask the Court to vary or discharge this Order. (2) If you disobey this Order you may be found guilty of Contempt of Court. If found guilty of contempt of Court you may be sent to prison or fined or your assets may be seized. An Application was made today, Thursday 16 April 1998, ex parte and without notice to any of the Defendants by Counsel for the Plaintiff to the Judge, Mr Justice Jowitt. The Judge heard the Application and read the Affidavit listed in Schedule 1 and accepted the undertakings set out in Schedule 2 of this Order. IT IS ORDERED that: 1. THE INJUNCTION Until midnight on Thursday 30 July 1998 or further order the Defendant is hereby restrained from uprooting, destroying or otherwise damaging or interfering with any of the Plaintiff's plants or crops at the sites listed in Schedule 3 to this Order or attempting or conspiring with another or others to do any such act. 2. ORDER AS TO SERVICE Provided the Plaintiff shall first have complied with its undertaking as to attempting to effect personal service at Schedule 2 to this Order, this Order may be served by the Plaintiff on the Defendant (a) if there is a letter box for the address listed for the Defendant at Schedule 4 to this Order, by inserting a copy of the Order and the Affidavits referred to at Schedule 1 to this Order in a sealed envelope addressed to the Defendant through the letter box, or (b) if there is no letter box for the address listed for the Defendant at Schedule 4 to this Order, by enclosing a copy of the Order and the Affidavits referred to at Schedule 1 to this Order in a sealed envelope addressed to the Defendant and affixing the same to the entry door for that address and transmitting a copy of the Order to the e-mail address for genetiX snowball, namely genetixsnowball@orangenet.co.uk, addressed to the Defendant. And in any event, by delivering a copy of the Order and Affidavits in a sealed envelope addressed to the Defendant to the premises One World Centre, 6 Mount Street, Manchester M2 5NS. 3. ORDER AS TO EXHIBIT "CLH3" The Plaintiff shall be at liberty to withhold from service upon and disclosure to the Defendant the exhibit marked "CLH3" to the Affidavit referred to at Schedule 1 to this Order. 4. COSTS OF THE APPLICATION The costs of this Application are reserved. 5. VARIATON OR DISCHARGE OF THIS ORDER The Defendant may apply to the Court at any time to vary or discharge this Order but if he wishes to do so he must first inform the Plaintiff's Solicitors in writing at least 2 working days beforehand. EFFECT OF THIS ORDER 1. A Defendant who is an individual who is ordered not to do something must not do it himself or in any other way. He must not do it through others acting on his behalf or on his instructions or with his encouragement. 2. A Defendant which is a corporation and which is ordered not to do something must not do it itself or by its directors, officers, employees or agents or in any other way. SCHEDULE 1 Affidavit The Judge read the following Affidavits before making this Order: 1. Catherine Lisa Hooper sworn on 15 July 1998. 2. William Davies sworn on 15 July 1998. 3. Antony Douglas Phillips sworn on 16 July 1998. SCHEDULE 2 Undertaking given to the Court by the Plaintiff 1. If the Court later finds that this Order has caused loss to the Defendant, and decides that the Defendant should be compensated for that loss, the Plaintiff will comply with any Order the Court may make 2. Forthwith upon the making of this Order, the Plaintiff will cause the following efforts to be made by its servant or agent to effect personal service on the Defendant: (a) two calls shall be made at the address for the Defendant listed at Schedule 4 to this Order at reasonable hours. (b) there shall be an interval of at least two hours between the two calls and one such call shall be made between the hours of 6pm and 10pm on Thursday 16 July 1998 save than in the case of the First and Fifth Defendants, both calls shall be made before 5.00pm. 3. To issue and serve in like manner provided for service of the Order and Affidavits a Summons seeking relief consistent with that the subject of the Order and returnable before the Court on 30 July 1998. Undertaking given to the Court by the Plaintiff's Solicitors 1. Messrs Rowe & Maw, the Plaintiff's solicitors, will hold and keep safe, pending further Order in this action, the exhibit "CLH3" to the First Affidavit of Catherine Lisa Hooper and, on receipt of reasonable copying charges or a satisfactory undertaking to pay the same, will provide a copy thereof to any solicitor or Counsel acting for the Defendant (provided that no partner or employee of such solicitors or Counsel is the Defendant) provided that the solicitor or Counsel shall first have undertaken in writing not to disclose the whole or any part of the contents thereof to the Defendant except with the leave of this Court.
